how do lichess know the difference bewteen a engine cheater and players who know opening “theory” when opening looks the same?

You don't need to worry about it.
You don't need to worry about it.
I often thought about this, because I memorize openings at the deepest level I can manage, but I think cheating looks differently. Lots of people know openings so I'm pretty confident that doesn't register as cheating. I think playing a series of best moves as a beginner would be highly unlikely and flag cheating. I think if Lichess revealed how they catch a cheater, we would have a lot more cheaters on this site trying to get around the system.
I have always played honest games for years here and never been mistaken as a cheater... so I don't think you have anything to worry about if you play fair. On the flipside, I have gotten a few points given back to me because some players cheated against me. Honestly, I didn't know players were cheating when that happened. It just felt like a low rated player was having a "good day." Only later did lichess catch the player who cheated.
I think their system, whatever it is, is effective.

I played a player in rapid few days ago and was refunded 10 rapid rating but when i looked in my games it doesn’t look like engine. I looked at the players last rated rapid game and It looks like theory. It was only 40 move game with innacuacies.

the question is how long does the game to distinguish theory vs engine if both games are < 40 moves?

game length doesn't matter. There are clever methods to detect intermittent cheating (proficient algorithms plus experienced mod team)
many games of banned accounts look normal, but that's just cuz we only know the most obvious ways of cheating
also I don't get what game you're referring to. In your recent rapid losses, I found a banned account that you only lost 4 points to, and a closed account you played twice but there were 52 and 24 moves, not around 40. (Please do not show the game/player name in public, PM me if anything)
