At least the moves leading up to the position are given in puzzles, so this puzzle is not impossible to solve. But it is a bit unfair, especially as most people probably won't look at the previous moves when solving a puzzle and they won't expect it to matter. In my opinion, the easiest fix would be to not even consider a position as a candidate for a puzzle if the position already appeared before in the game. That would eliminate all these tricky threefold puzzles. And the existing puzzles could be filtered by the same criteria, and those puzzles that meet the criteria could be removed.

Another similar issue is if it looks like castling is possible but it's not due to the king or rook having moved previously. Of course, I'm sure puzzles where this is an issue are very rare, and an easy fix would be to simply not include any puzzles with the king and rooks in their initial positions unless castling rights remain present. En passant is not really an issue because the last move is played on the board automatically.

P.S. In the game, Black took the repetition with 1 minute on the clock and mate in 1 on the board twice. I get it, White's up a piece and threatening mate, so you're looking to draw, but still painful to see.

In short, it's not mate in 2 cause you need to know how the position arose.
Also, puzzles like these exist and I have seen before.
