Is it a draw either way?

In a game I have a lone King. My opponent has a King, a Bishop and a pawn. My opponent has 1 second left with no increment. If my King captures his lone pawn it is an automatic draw. But if I sidestep the pawn and his time expires--what would the result be?

It still would be a draw, because you cannot checkmate your opponent with your lone king.

Thanks! So I assume it isn't a draw on the previous move as he still has sufficient material to checkmate me. Mostly rhetorical.
