I was literally publishing a new version every day based off feedback from people like Candidate Master Joshua Altman.
He, a chess prodigy, was playing the tactics trainer and telling me what he thought worked well and not so well, and I'd create a version just for him. The feedback and discussion is all on twitter from 2013. lol

Copying someone's code is pretty easy without knowing. And apart from patent there is original factor as well which works on whether other copied it or not. Plus, if OP can manage to show that chess.com used his then they would be penalised.
Also, chessmastercube is pretty old site and many have used it's idea. They should at least add reference the original. And patent is not always required. Other side can complain and if they can show then it's serious.

I think chess.com has copied more than your app. I'm not certain, but I don't think they created chess, I think they copied it from somewhere.

Others that weren't so honest tried to reverse engineer our engines and got sued for copying our design without respecting various patents we had.

the car example is perfect. if the engine has no patent, copying it is risky. after the patent expires, it can be freely copied.
amazon owned the patent to one click purchase, after it expired, everyone copied it.
