Draw by timeout vs insufficient material

But my opponent only has King + Knight left. Is this not supposed to be a draw by timeout vs insufficient material?

If a checkmate can be constructed by a series of legal moves, then material is sufficient.

Ok I see thanks for the responses. Still think it's a weird rule though because black can never force checkmate if white doesn't play ridiculous moves..
