Why is this not a draw?

This was a timeout so it's rather article 6.9. (Article 5.2.2 is about ending the game (without a timeout) when neither side can achieve a checkmate.)

There is a sequence of legal moves resulting in white getting checkmated, therefore black wins when white timed out.
