Yes, this comes under spam.
There is one more rule "don't tell others what they should do or what they are doing, there are mods to check issues". Why people decide who is spamming and try to control forums?

And I don't think that threads should necessarily be lambasted for how they start out, but should betimes be given room to grow. After all, as Miles Davis once observed: “It's not the note you play that's the wrong note – it's the note you play afterwards that makes it right or wrong.”

Because there are several useless forums created every now and then, so moderators can't go to every forum. Also, moderators first go to the recent forums and so if we post to not break Lichess Terms of Service then the thread remains active. Also, we can ping mods (not for fun) to tell them about someone not following the forum etiquette.
