K and b vs. k and b, can't claim a draw??

and yes. It is very simple that on online chess you dont have an arbiter. So with an arbiter present you can claim a draw in the K+B vs K+B game because the arbiter will probably give it (if you have increment you can just play for ever) and if you have less than 2min left you can claim under the g.5 rule if it is in effect. But online you dont have an arbiter and if there is technically a chance that Mate can occur then you must play on and cannot claim jack! :)
My client withdraws his claim... but insists that software could replace an arbiter at some point in the future since (even though complex) there exists a programable set of rules for this draw.

1. Game must be =\= (could use table base). 2. Both player must be able to demonstrate =\=. 3. In this situation, the clock does not get to decide the game. 4. Draw must be claimed.
