draw after 1 move repetition

I was playing a game and the opponent pressed draw but i did not agree and the system automatically made a draw but there was no 3 fold repetition. Please take a look at this bug.

There *is* a 3-fold repetition. Position after white's move #35, #37 and #39 is equal.
Always good to have concrete examples where the definition has to be re-emphasize. reminders to always say "3 fold repetition" of what? of position, not move. Having such a reminder makes things more memorable.

Indeed the FAQ. does tackle it. I don't think the op would be the only one to gloss over that part of the FAQ. Since the FAQ is there, linking to it saves the repeat. But seeing this title in the forum title ticker of the main page, once in while, will attract the attention. and make people see concrete examples from the community.

I do agree that the "bug" appellation was hasty, showing the extent to which the op was convinced of "3 fold rep." applying to move. So we do the post with the link to the well written FAQ, but now there is a "face" to that paragraph, it is the first post here.
Thanks for the explanation. I have been playing chess professionally for a while and I thought that a draw is claimed after 3 moves are repeated, not 3 positions, but this will change my perspective. Either way, I think a draw should only be agreed in a position where there is no possible way to win, not just by claiming it.
FYI. OTB White would claim a draw before making his 39 move! He declares his intention to play that move, but does not make it, and claims it will cause the 3rd repetition of position. He also writes the move on his scoresheet. See the FIDE rules.
so you are saying that white has to claim the draw (not black) ?
