Warning for Letting Your Clock Run Out

How do you know if a player is thinking about a move , wracking their brains to find that move that solves all their problems lol and the time runs out or that they are cynically "punishing" his opponent for obtaining a winning position and letting the time run out which would cost the opponent valuable time if they were playing in an Arena Tournament for instance.

Is it fair to warn people and threaten them with a temporary ban for thinking in a chess game? Just asking.
@michuk Sometimes there is intentional prolonged thinking if you're going to call it that.
@AlAnLiAnG Yeah okay some players do that and it's bad like I said how do we tell the difference so that I can think for as long as I need to without being warned about a temporary ban or temporarily banned?
@michuk It depends on the time control. If it is bullet, and they let their time run out, either disconnection or intentional. It varies from time control to time control.
@michuk All I can say is that if you play a longer time control, there will (and should) be more thinking involved.
I agree that I find it extremely annoying when I have 3 seconds left on the clock, am wrecking my brains on how to get out of a position and the time runs out. Then on top of that you get this warning. Can be easily fixed by setting a threshold of say 15 seconds of doing nothing for that warning. It really rattles me to get a warning for nothing.
I dont think its bad if its ub and it is like 5 seconds but I once played a classical game and I had mate in one and my opponent just sat there for 14 minutes, I think that should be punishable.
If you are trying to look for a move and can't find one you can just make a move a couple seconds before your time runs out and hope for the best, it's better than losing on time where your chance of success is 0%...
I'm not advocating for unsportsmanlike play, I'm saying if you are actually trying to think and find a move at least make a move before you lose on time because losing on time is pointless.
