Well, after Kh1 its a repetition of moves. Even though its no threefold, SF will rate this as 0.00 and won't look any further which leads to such a strange evaluation. If not SF would probably play way too much repetitions all the time (not that I'm too sure about all the reasons though).
So its not a bug but a feature which won't be changed.
No, 39. Kh1 would have been the third: 35. Re7 and 37. Re7 were the others. The draw score is correct.
